Estos son los términos entre Cancha Club Management y el club que contrata el servicio. Están escritos para que los entienda quien dirige un club, no solamente un abogado. Si algo aquí le parece confuso, escríbanos y se lo explicamos antes de que firme.
These are the terms between Cancha Club Management and the club that subscribes. They are written to be understood by whoever runs a club, not only by a lawyer. If anything here is unclear, write to us and we will explain it before you sign.
Cancha Club Management ("Cancha", "nosotros") es un programa de administración de clubes juveniles de fútbol, que funciona en los dos idiomas. El club ("usted") lo usa desde el navegador; no hay nada que instalar ni que mantener.
Cancha Club Management ("Cancha", "we", "us") is club-management software for youth soccer clubs, built to work in both languages. The club ("you") uses it from a browser; there is nothing to install and nothing to maintain.

These terms are between Cancha and the club. Families and coaches use the club's site; what a family pays for is the club's programme, not a service of ours, though the payment is processed through Cancha as section 6 explains.

The club owns its data — rosters, families, players, documents, messages, schedules and financial records. We hold it to provide the service and for no other purpose.

With one clarification we would rather state plainly: to translate, the text of announcements and private messages is sent to an outside translation service, and the original text and its translation are kept so the same sentence is not translated twice. That is processing to deliver the service — not advertising and not model training. Privacy lists everyone we work with.

Two more things a club should know before signing. The database is backed up nightly and the backups are kept for 30 days; those backups contain children's data. And the platform operator holds a technical administrator access that reaches any club's console, including medical notes and documents. We use it for support and for fixing faults, not for anything else, but we would rather you knew than found out.

The club must also follow Stripe's rules, including its restricted and prohibited business list. If your club plans to collect for raffles, drawings or other fundraising that Stripe restricts, say so first: it may need Stripe's prior approval and not all of it can be collected here.

There is no setup fee. Setting the club up costs nothing and nothing is due at signing. It includes configuring the club's account and public site, importing whatever roster the club already keeps, connecting payment processing if the club wants it, and training the club's staff.

Put plainly: a fee for each player whose dues for that month were recorded as paid, at the rate agreed in writing with the club, recurring for as long as the service is active. It is the same figure however the family paid — cash, Zelle, Venmo, Cash App, cheque, card and bank transfer all count identically, and the method makes no difference to what the club owes. Nothing is rounded in our favour.

A player is counted once in a month if a monthly dues installment falling due in that month is recorded as paid — once, however many charges the club issued that player. Waitlisted players, withdrawn players, players the club has not billed, and every charge that is not recurring monthly dues (5.6) do not count. A payment recorded late counts in the month its installment fell due, not the month it was entered.

The per-player fee and the monthly minimum are the two figures set out in the club's written agreement, agreed before signing. They do not change without the 60 days' notice in 5.5.
Nunca le cobramos por un jugador que no le pagó. La cuota es por cada jugador cuya mensualidad de ese mes quedó pagada — en efectivo, por Zelle, con tarjeta o desde el banco, da lo mismo.
We never charge you for a player who hasn't paid you. The fee is for each player whose dues for that month were recorded as paid — in cash, by Zelle, by card or from the bank, it makes no difference.
Lo que sí hay es una cuota mínima mensual para el club. Si en un mes las cuotas por jugador suman menos que ese mínimo, usted paga el mínimo — y sí, eso puede pasar en un mes flojo en el que casi nadie le pagó. El mínimo es por el club, no por ningún jugador, y está topado: nunca puede ser más de lo que habría costado ese mismo mes si todas las familias hubieran pagado. En un mes en que usted no cobra mensualidades —la temporada baja— el mínimo es cero y no se le factura nada.
What there is, is a monthly minimum for the club. In a month when the per-player fees come to less than the minimum, you pay the minimum — and yes, that can happen in a lean month when almost nobody paid you. The minimum is a charge for the club, not for any player, and it is capped: it can never be more than that same month would have cost if every family had paid. In a month when you bill no monthly dues at all — the off-season — the minimum is zero and nothing is invoiced.

It exists because carrying a club on the service costs us roughly that much every month whatever happens inside it — payment-account fees, hosting, backups, and someone answering the phone. A month at the minimum earns us nothing.

Your club's exact figures are in your agreement before you sign it, and the whole month's calculation is in the app before anything is collected.

The club sets what families pay. Cancha does not. On each payment made through the service, the club receives the amount paid less the cost of processing it and less the Cancha fee, and nothing else. If the club offers a sibling or hardship discount, that discount comes out of the club's share: it does not reduce the Cancha fee, and Cancha does not fund it.

If payment-processing rates change materially, both parties will discuss these figures in good faith.
Donde la familia paga por el servicio, la cuota se descuenta de ese pago en el momento. Todo lo demás —los jugadores que le pagaron al club en efectivo, por Zelle, con cheque o de cualquier otra forma fuera del servicio, más lo que agregue la cuota mínima de 5.3— se junta durante el mes y se cobra con un solo cargo automático a la cuenta bancaria del club. Ese cargo lo autoriza el club al firmar su contrato de servicios (§3.5 de ese contrato). Le mandamos el estado de cuenta con el monto exacto y la fecha por lo menos diez días antes, y nunca se genera un cargo por $0.00. Lo que ya se debe, si el club revoca la autorización, se factura y se paga a 30 días. Las dos vías nunca se traslapan: un mes de jugador nunca se cobra dos veces. El club puede ver el cálculo completo, mes por mes, dentro de la aplicación en "Facturación de Cancha".
Where a family pays through the service, the fee comes out of that payment at the time. Everything else — the players who paid the club in cash, by Zelle, by cheque or in any other way outside the service, plus anything the monthly minimum in 5.3 adds — accumulates through the month and is collected as one automatic debit to the club's bank account. The club authorises that debit by signing its services agreement (§3.5 of that agreement). We send the statement with the exact amount and the date at least ten days beforehand, and no debit is ever initiated for $0.00. If the club revokes the authorisation, whatever is already owed is invoiced and payable within 30 days. The two never overlap: a player-month is never charged twice. The club can see the whole calculation, month by month, inside the app under "Cancha billing".

Any fee change requires 60 days' written notice. If the club does not accept the change, it may end the service before the change takes effect, at no penalty.

We do not currently offer a free trial, an introductory discount or any promotion. If we ever do, its terms will be written next to the offer.
Inscripción anual, cuotas de liga, credenciales, equipo, campamentos, torneos, equipos de adultos y recaudación de fondos van al costo: el club recibe el monto cobrado menos lo que cueste procesarlo, y la cuota de Cancha sobre ellos es cero, en cualquier método de pago. No son meses de jugador y nunca generan cuota, factura ni cargo. Aplica un mínimo de $1.00 por cobro, porque un pago con tarjeta más chico que eso cuesta más procesarlo de lo que cobra.
Annual registration, league fees, player cards, equipment, camps, tournaments, adult-league fees and fundraising run at cost: the club receives the amount charged less what it costs to process it, and the Cancha fee on them is zero, on every payment method. They are not player-months and they never give rise to a fee, an invoice or a debit. A minimum of $1.00 applies to any single charge, because a card payment smaller than that costs more to process than it collects.

Over time we may add optional features with their own price. None is ever switched on, and no such price is ever charged, unless the club asks for it. We describe the feature and its price in writing, and it takes effect only when someone authorised by the club turns it on. The club is free to decline, to say nothing at all, or to turn it off later on 30 days' notice, and in every one of those cases nothing changes and nothing is owed. Nothing the club already has at no charge can become chargeable this way: making it chargeable is a fee change and carries the 60 days' notice in 5.5.

Card and bank payments are optional. The club does not have to accept them, and the rest of the service works without them: families pay the club however they already do, the club records those payments, and the fee is collected in the monthly debit in 5.5. If the club never connects a payment account, this section is simply unused.

Payment processing is performed by Stripe. The club opens and controls its own Stripe connected account, in the club's own name, and is bound by Stripe's terms. We are not a bank; the payment processor is Stripe, not Cancha.

Payment processing services are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (collectively, the Stripe Services Agreement). By accepting these terms, or by continuing to operate the club on the service, the club agrees to be bound by the Stripe Services Agreement, as Stripe may modify it from time to time. As a condition of Cancha enabling payment processing, the club agrees to provide accurate and complete information about itself and its activities, and authorises us to share it with Stripe.

Here is exactly how the money moves. When a family pays, the charge settles on Cancha's Stripe platform account, Stripe retains the Cancha fee from section 5 there as an application fee, and transfers the remainder to the club's Stripe balance. From there Stripe pays the club out to the club's own bank, on the club's own payout schedule. Stripe — not Cancha — decides when that payout arrives.
Cancha no guarda el dinero del club en ninguna cuenta bancaria propia, ni decide cómo lo gasta el club. Cuando una familia paga por el servicio, nuestra cuota la descuenta Stripe en el momento de la transacción. Cancha holds no club funds in a bank account of its own, and does not decide how the club spends its money. When a family pays through the service, our fee is deducted by Stripe at the moment of the transaction. When the family pays the club directly, that same fee is collected afterwards, in the monthly bank debit in 5.5. It is the same figure either way, and we receive nothing else. No family payment passes through a Cancha bank account. The club's Stripe account, and any money in it, are the club's throughout, and reach the club's own bank within days.

On the family's statement, the charge appears under the club's own name, from the club's own Stripe account settings: the club is the business of record on the payment, so a parent recognises it as their child's dues.

Who answers for a dispute. The club decides whether to refund a family, and can do it from the app. Although the club is the business of record, the charge settles on Cancha's platform account, and Stripe debits Cancha first for chargebacks and disputes over those dues. We work them together with the club, which knows the family and the case, and we recover the disputed amount from the club's Stripe balance.

The Cancha fee on a refund: if a family's payment is refunded in full, our fee is returned in full; if the refund is partial, the fee is retained. The rest is on Refunds.
El programa, su diseño, su código y el nombre Cancha son nuestros. Mientras el servicio esté vigente, el club tiene permiso de usarlo para administrar su club — un permiso no exclusivo, no transferible y sin derecho a sublicenciarlo.
The software, its design, its code and the Cancha name are ours. For as long as the service is running, the club has permission to use it to run its club — a non-exclusive, non-transferable licence with no right to sublicense.

What the club uploads stays the club's: its crest, its colours, its words, its photos and its families' information. The club gives us only the permission needed to host, display, translate and back it up in order to run the service. That permission ends when the service ends, apart from backups while they age out.

If the club sends us a suggestion for improving the product, we may use it without owing anything for it.
Cada parte va a cuidar la información no pública de la otra que reciba por esta relación, y no la va a usar para nada distinto de hacer funcionar el servicio. Esto no aplica a lo que ya era público, a lo que la parte ya sabía sin obligación de reserva, ni a lo que la ley obligue a entregar — y en ese último caso se avisa a la otra parte, si la ley lo permite.
Each side will look after the other's non-public information that it receives through this relationship, and will not use it for anything other than making the service work. This does not cover what was already public, what the party already knew without an obligation of confidence, or what the law requires be handed over — and in that last case we tell the other party, where the law allows.

Beyond what this page says, the service is provided "as is" and Cancha disclaims all other warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not promise the service will be error-free or uninterrupted, and we do not promise machine translations are perfect: for a legal or medical document, have someone check it before you send it.
Ninguna de las dos partes responde ante la otra por daños indirectos, incidentales o consecuenciales, ni por lucro cesante o pérdida de prestigio.
Neither party is liable to the other for indirect, incidental or consequential damages, or for lost profits or lost goodwill.
La responsabilidad total de Cancha bajo estos términos, por todas y cada una de las reclamaciones, se limita a las cuotas que el club le pagó a Cancha en los tres meses anteriores a que surgiera la reclamación. Cancha's total liability under these terms, for any and all claims, is limited to the fees the club paid Cancha in the three months before the claim arose. Given the fee level, the club should understand this is a small number, and should carry its own insurance for the risks that matter to it.

Nothing here limits liability for fraud, wilful misconduct, or anything that cannot be limited by law.

The service runs month to month. There is no minimum term and no cancellation fee. The fee in section 5.2 and the minimum in section 5.3 keep accruing every month until the club cancels.

Cancha puede suspender el servicio con 15 días de aviso por facturas sin pagar o por un cargo al banco devuelto dos meses seguidos, y de inmediato si el servicio se está usando de forma ilegal.
Cancha may suspend the service on 15 days' notice for unpaid invoices or a bank debit returned in two consecutive months, and immediately if the service is being used unlawfully.

Podemos actualizar esta página. Si el cambio afecta de forma importante los derechos u obligaciones del club, se lo avisamos por correo electrónico con al menos 30 días de anticipación — y si el cambio es de cuotas, con 60 días, como dice la sección 5.5. We may update this page. If a change materially affects the club's rights or obligations, we will email you at least 30 days beforehand — and if the change is to fees, 60 days, as section 5.5 says. If the club does not accept it, it may end the service before the change takes effect, at no penalty. Minor changes and corrections show up as a new "Last updated" date at the top.
